www.birdyandblue.co.uk is a site operated by Sarah Willock, trading as 'Birdy & Blue'.

Your personal data will be used to provide the information, goods and services offered through our website to you, for billing and order fulfilment.

Our Privacy Policy describes how and when I collect, use, and share information when you purchase an item from me, contact me, or otherwise use my services through www.birdyandblue.co.uk or its related sites and services.

To fulfil your order, you must provide me with certain information, such as your name, email address, postal address, payment information, and the details of the product that you’re ordering. You may also choose to provide me with additional personal information (for a custom order for example), if you contact me directly. 

I rely on a number of legal bases to collect, use, and share your information, including: 

  • as needed to provide my services, such as when I use your information to fulfil your order, to settle disputes, or to provide customer support; 
  • when you have provided your affirmative consent, which you may revoke at any time, such as by signing up for my mailing list; 
  • if necessary to comply with a legal obligation or court order or in connection with a legal claim, such as retaining information about your purchases if required by tax law; and 
  • as necessary for the purpose of my legitimate interests, if those legitimate interests are not overridden by your rights or interests, such as 1) providing and improving my services. I use your information to provide the services you requested and in my legitimate interest to improve my services.

Information about my customers is important to my business. I share your personal information for very limited reasons and in limited circumstances, as follows: 

  • Service providers. I engage certain trusted third parties to perform functions and provide services to my shop, such as delivery companies. I will share your personal information with these third parties, but only to the extent necessary to perform these services. 
  • Compliance with laws. I may collect, use, retain, and share your information if I have a good faith belief that it is reasonably necessary to: (a) respond to legal process or to government requests; (b) enforce my agreements, terms and policies; (c) prevent, investigate, and address fraud and other illegal activity, security, or technical issues; or (d) protect the rights, property, and safety of my customers, or others. 

 I retain your personal information only for as long as necessary to provide you with my services and as described in my Privacy Policy. However, I may also be required to retain this information to comply with my legal and regulatory obligations, to resolve disputes, and to enforce my agreements. I generally keep your data for the following time period: 5 years. 

I may store and process your information through third-party hosting services in the US and other jurisdictions. As a result, I may transfer your personal information to a jurisdiction with different data protection and government surveillance laws than your jurisdiction. If I am deemed to transfer information about you outside of the EU, I rely on Privacy Shield as the legal basis for the transfer, and all hosting services I use are Privacy Shield certified regarding the collection, use, and retention of personal information transferred from the European Union, the European Economic Area, and Switzerland to the United States. 

If you reside in certain territories, including the EU, you have a number of rights in relation to your personal information. While some of these rights apply generally, certain rights apply only in certain limited cases. I describe these rights below: 

  • Access. You may have the right to access and receive a copy of the personal information I hold about you by contacting me using the contact information below. 
  • Change, restrict, delete. You may also have rights to change, restrict my use of, or delete your personal information. Absent exceptional circumstances (like where I am required to store data for legal reasons) I will generally delete your personal information upon request. 
  • Object. You can object to (i) my processing of some of your information based on my legitimate interests and (ii) receiving marketing messages from me after providing your express consent to receive them. In such cases, I will delete your personal information unless I have compelling and legitimate grounds to continue using that information or if it is needed for legal reasons. 
  • Complain. If you reside in the EU and wish to raise a concern about my use of your information (and without prejudice to any other rights you may have), you have the right to do so with your local data protection authority.

Email Newsletter

  • If you sign up to our newsletter we may use your email address to send you information about products or services.
  • You can opt out of these at any point and you can ask for personal data to stop being recorded at any time.

We may also disclose aggregate statistics about visitors to our website (customers and sales) in order to describe our services to prospective partners (advertisers, sponsors) and other reputable third parties and for other lawful purposes, but these statistics will include no personally identifiable information.

Orders and Shipping

All orders are dispatched within 1-2 business days of you placing them, and often sooner.

    All orders to UK destinations are sent via Royal Mail First Class post, and should arrive in 1-2 business days of despatch.
    All our International orders are sent via Royal Mail International Tracked & Signed service, which provides end-to-end tracking and signature upon delivery.  This ensures your fabrics are safe and secure, wherever in the world they're heading.
     
    Buyers are responsible for any customs and import taxes that may apply.  We are not responsible for delays due to customs.

     

    Right to Cancel

    All customers have the right to cancel their orders under The Distance Selling Regulations which gives consumers extra protection when buying online. Specific legislation here that applies is regulation of The Distance Selling Regulations.

    You have the right to cancel the purchase of a good without having to give a reason at any time within the "cooling off period" of seven working days, beginning on the day after you receive the goods.

    Beyond this right we gladly accept returns, exchanges and cancellations on the following terms:

    • Just contact us within: 14 days of delivery
    • Ship items back to us within: 30 days of delivery
    • Request a cancellation within: 1 hour of purchase

    However because of the nature of these following items, unless they arrive damaged or defective, we can't accept returns for: 

    • Custom or personalised orders
    • Digital downloads

    Buyers are responsible for return shipping costs. 

    If you are in possession of the goods you are under the duty to retain them and take reasonable care of them. You must send the goods back to us to our contact address at your own cost (unless we delivered the item to you in error or the item is damaged or defective) as soon as possible once you have cancelled the contract.

    We reserve the right to make a charge not exceeding our direct costs of recovering the goods if you do not return the goods or return them at our expense.

    Once you have notified us that you wish to cancel the contract, any sum debited to us will be refunded to you as soon as possible and in any event within 30 days of your cancellation.

      All notices you send us must be sent to the contact details on this site, or to our email address: fabrics@birdyandblue.co.uk. We may give notice to you at either the email or postal address you provide to us when making a purchase. (Notice will be deemed received and properly served 24 hours after an email is sent or three days after the date of posting of any letter.) In providing the service of any notice, it will be sufficient to prove, in the case of a letter, that the letter was properly addressed, stamped and placed in the post and, in the case of an email that the email was sent to the specified email address of the addressees.

      These terms are governed by English law. Any contract for the purchase of goods from this site and any dispute or claim arising out of or in connection with any such contract will be governed by English law. You and we both agree that the courts of England and Wales will have non-exclusive jurisdiction. However, if you are a resident in Northern Ireland you may also bring proceedings in Northern Ireland, and if you are a resident in Scotland you may also bring proceedings in Scotland.
